Article 1157. Obligations arise from:

(1) Law;

(2) Contracts;

(3) Quasi-contracts;

(4) Acts or omissions punished by law; and

(5) Quasi-delicts

ARTIKULO 1157: Ang mga obligasyon ay maaaring manggaling sa:

  1. Batas
  2. Kontrata
  3. Quasi-Kontrata
  4. Kilos o kilos na masama na pinaparusahan ng batas;
  5. Quasi-delicts

SOURCES OF OBLIGATIONS

(a) LAW wherein they are imposed by law itself.
Examples: obligation to pay taxes and obligation to support one’s family
 
(b) CONTRACTS when they arise from the stipulations of the parties.
Example: obligation to repay a loan by virtue of an agreement
 
(c) QUASI-CONTRACTS when they arise from lawful, voluntary and unilateral acts which are enforceable to the end that no one shall be unjustly enriched or benefited at the expense of another.
Example: obligation to return money paid by mistake or which is not due
 
(d) CRIMES OR ACTS OR OMISSIONS PUNISHED BY LAW when they arise from civil liability which is the consequences of a criminal offense.
Example: obligation of the thief to return the car stolen by him
 
(e) QUASI-DELICTS OR TORTS when they arise from damage caused to another through an act or omission, there being fault or negligence, but no contractual relation exists between the parties.
Example: obligation of the possessor of an animal to pay for the damages which it may have caused.
